These Terms of Service ("Terms") govern your use of mightyturfinc.com (the "Site") and any purchase of products or services from Mighty Turf Inc. ("Mighty Turf", "we", "us"). By using the Site or placing an order, you agree to these Terms.
Mighty Turf sells wholesale to contractors, landscapers, sports field builders, general contractors, institutional buyers, and similar trade professionals. We do not sell directly to homeowners or end consumers. Homeowners seeking installation services are routed to our Certified Installer network, including Monarch Landscape Design across Southern California.
Prices shown in casual reference (on the Site, in conversation, or in preliminary discussions) are estimates and are subject to change without notice. A binding price is established only by a written quote issued by Mighty Turf for a specific product, quantity, and delivery window. Quotes are valid for the period stated on the quote, typically 14 to 30 days.
All orders are subject to acceptance by Mighty Turf. Payment terms are cash or card at pickup or delivery unless a trade credit account has been established in writing. Trade accounts with Net 30 or other agreed terms require credit approval through our trade account application process.
Past-due balances accrue interest at 1.5% per month (18% APR) or the maximum rate permitted by California law, whichever is lower. Accounts past due may be placed on hold until current.
Mighty Turf offers job-site delivery and will-call pickup from our Fontana warehouse. For delivery, risk of loss transfers to you upon delivery to the agreed location. For will-call, risk of loss transfers upon loading onto your vehicle. You are responsible for inspecting product at the time of delivery or pickup and noting any visible damage on the receipt. Claims for visible damage must be made at that time.
Full, unopened rolls in original condition may be returned within 14 days for a refund less a restocking fee, subject to inspection. Cut-to-order product, partial rolls, custom cuts, and any product that has been installed, altered, or used are non-returnable. Defective product is covered under the product warranty — see Warranty.
Mighty Turf products are covered by a manufacturer warranty. See the Warranty page for terms, coverage, exclusions, and claim procedures. The warranty is the sole warranty offered by Mighty Turf. All other warranties, express or implied — including implied warranties of merchantability and fitness for a particular purpose — are disclaimed to the fullest extent permitted by California law.
Installation is not performed by Mighty Turf. Proper installation is the responsibility of the installer, whether that is you, your crew, or a third party you engage. Warranty coverage requires installation in accordance with published Mighty Turf installation specifications, which are available upon request and provided to Certified Installer partners.
To the fullest extent permitted by California law, Mighty Turf's total liability arising out of or relating to these Terms, any product, or any service shall not exceed the amount paid by you for the specific product or service giving rise to the claim. In no event shall Mighty Turf be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, loss of business, or job-site delay costs, even if advised of the possibility of such damages.
You agree to indemnify and hold harmless Mighty Turf, its officers, employees, and affiliates from any third-party claims arising out of your use or installation of our products, your breach of these Terms, or your violation of any law or the rights of a third party.
All content on the Site — including text, graphics, logos, product photography, and the Mighty Turf name and marks — is the property of Mighty Turf Inc. or its licensors and is protected by U.S. and international copyright and trademark law. You may not reproduce, distribute, or create derivative works from Site content without written permission.
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute arising out of these Terms or any Mighty Turf product or service shall be brought exclusively in the state or federal courts located in San Bernardino County, California, and you consent to personal jurisdiction and venue there.
We may update these Terms from time to time. The "Last updated" date at the top indicates when the Terms were last revised. Continued use of the Site or placement of orders after changes are posted constitutes acceptance of the updated Terms.
